Accepting quotation and job order will be taken as acceptance of the following terms & conditions. Please ensure you have read and fully understand the following. Contact us if anything is unclear.
All costs or prices provided exclude GST where applicable and are valid for thirty days from the date of the quotation.
No creative work start without a minimum non-refundable payment of 50% of the agreed costs. This amount is to ensure the agency is equipped to provide the best of our service and expertise.
Only digital work – will be shown after the pending amount is cleared. If the project is design & print, the design will start after 50% advance and will be processed for printing only after the pending 50% is paid.
The Design presentation will only be done it Shemoil’s office. If you are not willing to visit our office, you can pay the whole agreed amount of the job, and the agency will mail you the design or send you by other means.
Any designing job includes only 3 revisions, revisions include only text and minor changes. Extra revisions will be charged, a new design will be charged as per a complete re-design.
The work will usually commence within ten working days from the day of advance payment unless otherwise agreed in written form. The deadline provided to you will include design only, revisions, or re-design (only if charges are paid) is not included in the timeline.
Changes in the design to be mailed or to be agreed in writing. If the client fails to inform any changes in any stage of revision and tells later will be taken as extra revision and will be charged if 3 revision stages are completed.
Unless otherwise agreed in writing, our fees exclude: any kind of stock images, photography, copywriting, website domain, web hosting or backups, translation or typing in other languages except English, travel or delivery outside Kharghar, talent (models and actors, etc.) any third party media, production, distribution, couriers, proofs, mock-ups, printing, or other third party costs such as merchant bank and payment gateway charges, etc.
The outcome of color in the design and in print is not guaranteed to be the same, although it will be identical. If the client prefers to use their own supplier, we will not be able to monitor, advise, or take any responsibility for the print process or the final product.
Until the complete payment is received, all the designs, artwork, and products remain the intellectual property of Shemoil Design.
Unless otherwise agreed in writing, our fees or charges do not include any kind of storage or storage devices. The agency does not keep any data after 30 days from the delivery of the final product. All the data can be collected within 30 days from our server. If the data is not collected from our server within 30 days and it gets expired, the agency is not responsible for it in any way. If the client prefers to store data at our server, he/she has to pay Rs. 250/- per month (billed annually), i.e., Rs. 3,000/- per annum.
The data will only be provided in the following formats; ai (Adobe Illustrator), pdf (Portable Document Format), jpeg (Joint Photographic Experts Group). Any other file format required by the client will be charged accordingly.
The agency will not provide clients with any design files that were unused or rejected. Ownership and copyright for those designs remain property of Shemoil Design for non-exclusive future use.
The agency will not at any time or manner, directly or indirectly, use for our personal benefits, or disclose or communicate in any information that is proprietary to the client. We will do our best to protect such information and treat them as strictly confidential.
Shemoil Design uses only paid and secure mail service. The agency only communicates with clients by “email@example.com” (for the complete process for any job) or “firstname.lastname@example.org” (for accounts related conversations only). If the client receives or communicates with any person other than the mentioned mail IDs, Shemoil Design is not responsible for any loss of data, virus, or any fraud. We act reasonably to protect such threats and acts.
The agency will not be held responsible for any delays, errors, or losses arising from any third party or client.
The client must inform the agency in writing in case of any defects or problems with the work and services provided within 30 days of the final invoice date. The agency will not be held liable for any claims made after this period. After handing over the final product to the client, the client’s concerned person, or the transporter releases the agency as being responsible for any damage dealt with the product.
These terms and conditions of business apply to all present and future projects unless otherwise agreed upon in writing. Shemoil Design reserves the right to change or modify these terms at any stage with immediate effect without any prior notice. By agreeing to these terms and conditions, your statutory rights are not affected.
